Terms of Service

Using DBD
DBD Brand Studio is creative and marketing software. By creating an account or using DBD, you agree to these Terms and to the Privacy Policy. You must be legally able to enter this agreement and keep your account credentials secure. You are responsible for activity under your account and for authorized team members you invite.
Your content and rights
You retain ownership of the brand information, assets, media, prompts, and other content you provide. You grant DBD the limited right to store, process, reproduce, and transmit that content only as needed to operate the services you request. You confirm that you have the rights, permissions, releases, and authority needed for uploaded people, products, trademarks, music, media, claims, and connected accounts.
DBD intellectual property
DBD, its software, interface, workflow design, templates, documentation, prompts, logos, and other product materials are proprietary and protected by applicable intellectual-property laws. Except for the limited right to use the service, these Terms do not transfer DBD ownership to you. You may not copy, reverse engineer, resell, sublicense, or use DBD to build a competing service except where applicable law does not allow that restriction.
Generative tools and human review
Brand Brain guides managed synthesis, research, transcription, and image creation using approved brand information. Generative tools may make mistakes, produce inaccurate or incomplete material, or create output that is unsuitable for your purpose. DBD does not guarantee originality, legal clearance, factual accuracy, platform acceptance, commercial performance, or a particular creative outcome. You must review and approve every output before use, publication, distribution, or production.
Credits, payments, and refunds
Credits are consumed for managed generative operations at the displayed rate. A credit purchase is a prepaid right to request those operations; it is not a guarantee that every result will meet your preferences. Used credits are non-refundable, including where an otherwise valid generated result needs creative revision. DBD does not charge credits for a provider failure that returns no usable result. Prices, beta discounts, and credit rates may change prospectively with notice in the app. You are responsible for applicable taxes and payment-method charges.
Teams and cloud workspaces
Workspace owners and administrators control invitations, roles, shared brand access, and certain source-brand records. Administrators do not gain ownership of another member’s personal account or credit balance. Each person must use only their own account. You are responsible for choosing appropriate permissions and removing access when a teammate no longer needs it.
Acceptable use and third parties
You may not use DBD for unlawful, deceptive, infringing, abusive, harmful, privacy-violating, or unauthorized activity. Do not upload material you lack rights to use or use DBD to impersonate people, evade platform rules, create deceptive content, or distribute malware. Social networks, generative service providers, and payment processors are independent services with their own rules. Their availability and acceptance are not guaranteed by DBD.
Disclaimers and liability
To the fullest extent permitted by law, DBD is provided on an “as is” and “as available” basis. We do not warrant uninterrupted service, error-free output, or absolute security. Nothing in these Terms excludes obligations that cannot legally be excluded. To the fullest extent permitted by law, DBD’s total liability arising from the service is limited to the amount you paid to DBD for the service in the twelve months before the event giving rise to the claim. You agree to indemnify DBD for claims arising from your content, your misuse of the service, or your breach of these Terms.
Changes, suspension, and contact
We may update the service or these Terms, suspend access for security, legal, or misuse reasons, or discontinue a feature with reasonable notice where practical. Continued use after an effective update means you accept the updated Terms. Questions or notices may be sent to hello@agencystudio.cc.
Recraft visual production
By choosing a Recraft-powered generation or editing action, you authorize DBD to transmit the creative direction and selected source images, style references, or editor masks to Recraft solely to perform that action. You must have the rights required for submitted material. Provider processing and temporary result availability are governed by Recraft's terms; DBD preserves the durable project copy and operation lineage after import.
TikTok publishing
TikTok Direct Post is available only when TikTok has approved the capability for DBD and the connected account grants video.publish. Until then, DBD records provider-accepted legacy drafts, processing states, failures, and published posts separately; inbox delivery may require completion in TikTok. Platform capability, review, and publication decisions remain controlled by TikTok.
Business plans and the private beta
The first business on one local installation is free. Each additional business costs US $50 per month. Enterprise costs US $500 per month per shared business and includes the owner and up to five invited people. Cloud migration is an explicit owner choice after Enterprise is active. Exactly one member holds Master Brand editing authority; the owner can reassign it. Recurring charges, payment details and cancellation controls are shown in Stripe. Private beta credit purchases for eligible accounts are 40% off standard pack prices; subscriptions are not discounted. No free test credits are included. Paid features depend on successful payment and provider availability. Review the beta release notes for current limitations.
